Adjustments in Maximum Retail Price (MRP) Regulation of Certain Medicines that are Covered by Executive Order No. 155 Pursuant to Exemption from Value Added Tax (VAT)

     The DOH informs all concerned stakeholders that 11 drug molecules (12 drug formulations) under MRP regulation through Executive Order No. 155 are qualified for  VAT Exemption as these are also included in the VAT-Exempted List by the  Food and Drug Administration (FDA).

 

    The VAT exemption are imposed to prescription drugs and medicines for the treatment of diabetes, high cholesterol, hypertension, cancer, mental illness, tuberculosis, kidney disease, and COVID-19 as per Republic Act No. 11534, otherwise known as the “Corporate Recovery and Tax Incentives for Enterprises Act” or (CREATE Law). 

 

     Pursuant to the CREATE law, the Food and Drug Administration (FDA) issued an updated list of VAT-Exempt Products and thereafter endorsed the same to the Bureau of Internal Revenue.

 

    In line with this, the DOH- Centers for Health and Development are directed to disseminate the adjustments in the MRP of certain medicines covered by EO 155 to exclude the VAT.
